Glenn ORDINANCE NO. 10155 AN ORDINANCE CLOSING AND ABANDONING ALLEYS LOCATED NORTHEAST FROM ROSSVILLE AVENUE AND NORTHWEST FROM JEFFERSON STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned alleys located northeast from Rossville Avenue and northwest from Jefferson Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: A 14 foot wide alleyway beginning on the northwest line of Jefferson Street 461 feet northeast of the intersection of the northwest line of Jefferson Street with the northeast line of Rossville Avenue, and extending northwest between parallel lines 92 feet to the northwest line of lot 39, block 6, Montague's Addition No. 1, as shown by plat of record in plat book 2, page 34, ROHC. A 10 foot wide alleyway beginning on the southwest line of the above described 14 foot alleyway 46.67 feet northwest of the intersection of the southwest line of said 14 foot alleyway with the northwest line of Jefferson Street, and extending southwest some 233.33 feet between parallel lines to the northeast line (if extended) of tax parcel no. 145M-P-14; said alleyway being the east 10 feet of the north 233.33 feet of lot 4, Cotter Tract, as shown by plat of record in deed book M, volume 2, page 676, ROHC. Tax Map No. 145M-P-12, 13, and 15. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for Jupiter Industries, Inc., d/b/a Chattanooga Gas Company, of an easement the width of the streets for its gas main, lines and other distribution facilities located within the petitioned rights-of-way, which must be maintained for the use and benefit of its customers. 2. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 3. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 4. The areas reserved for utility easements must be kept free and clear of all structures. 5. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
